October 18 - ONTARIO TAKING STEPS TO PROTECT VULNERABLE WORKERS

TORONTO — The Ontario government intends to introduce legislation that, if passed, would require temporary help agencies (THAs) and recruiters to have a licence to operate in the province. Proposed changes would enable officers to levy penalties against an unlicensed THA or recruiter or a business who is using an unlicensed operator. As well, those who use deceitful recruiters could be required to repay workers for illegal fees charged. Ontario is also proposing to hire a dedicated team of officers to crack down on THAs and recruiters who are exploiting and trafficking domestic and foreign workers.
Under the proposed legislation, THAs and recruiters would be vetted before being issued a licence to operate. Applicants would need to provide an irrevocable letter of credit, that could be used to repay owed wages to workers. Penalties could be issued against unlicensed agencies and recruiters as well as the companies who use them, with proactive inspection measures to ensure compliance with applicable requirements. If the legislation is passed, the government intends to require licences as early as 2024.

October 18 - ONTARIO CONNECTING NEWCOMERS WITH OPPORTUNITIES IN THE SKILLED TRADES

OTTAWA — The Ontario government is investing over $900,000 to connect 900 new immigrants across the province with well-paying jobs as carpenters, electricians, plumbers, mechanics, welders, chefs and other in-demand trades. Through the free, virtual workshops, newcomers will receive the training and job connections needed to enter rewarding careers.

Details were shared today by Monte McNaughton, Minister of Labour, Training and Skills Development, who was joined by Goldie Ghamari, MPP for Carleton, and Jeremy Roberts, MPP for Ottawa West-Nepean, at the YMCA/YWCA of the National Capital Region in Ottawa.

“Across the province, we continue to hear from businesses in the skilled trades who can’t find the workers they need to grow,” said Minister McNaughton. “These are bigger paycheques waiting for hardworking people to collect them. This program will connect newcomers with the training and support they need to fill these good local jobs and build better communities.”

October 18 - ONTARIO TO TIGHTEN RULES FOR TEMP AGENCIES, FIRMS THAT RECRUIT FOREIGN WORKERS

The Ontario government is set to bring in the province's strictest-ever rules for companies that recruit temporary workers, including a system for shutting down temp agencies that exploit staff, CBC News has learned.

Senior officials with the Ministry of Labour say the plans include mandatory licensing for temporary help agencies, giving the province the power to stop firms from operating if they violate employment standards.

The government will also create a dedicated team of inspectors to root out illegal treatment of workers and recover unpaid wages.

The changes will be part of upcoming legislation that will make Ontario's protection of temp workers the strongest in Canada, he said.
"We'll be bringing forward legislation this month focused on protecting all workers, because enough is enough and we can do better," he said during a speech to the annual general meeting of the Provincial Building and Construction Trades Council, an umbrella group of unions.

Applicants need to access the OINP e-Filing Portal from the Masters Graduate stream page on the OINP website, then click on the button ‘Submit an application’. Applicants who successful register will receive a confirmation number by email within three business days with their file number. They need to submit their application within 14 days.

• English or French language proficiency of CLB 7

By moving to an expression of interest system OINP hopes to avoid the uncertainty related with the streams opening and closing.

July 20 - OINP will be now accepting applications to the Employer Job Offer: Foreign Worker stream

Starting tomorrow, July 21, 2020, The Ontario Immigrant Nominee Program (OINP) will begin accepting applications to the Employer Job Offer: Foreign Worker stream.

As OINP expects a high volume of users to access the e-Filing portal at the time of opening, some users may be placed in a priority queue.  Should this happen it is not a technical error. Once the limit has been reached, the system will automatically prevent further registrations from being submitted.

Applicants must access the OINP e-Filing portal directly from the Employer Job Offer: Foreign Worker Stream page of the OINP webpage. To submit, click the button ‘submit an application’. OINP suggests not to use a cell/mobile phone to apply.

Important: Use New Employer Form

Due to the current economic and employment conditions and to make sure the application is processed in a timely manner, applicants must submit the most recent version of the Employer Form, which must be completed and dated only on July 21st, 2020.

Although the Employer Form indicates that it must be submitted within six months from the date of signing, it is very important at this time that the information contained in the Employer Form be current. If an Employer Form is completed and dated before July 21st,  the application will be returned as incomplete. After successfully registering, the applicant will have 14 days to complete and submit the application. They will be able to use this time to upload an up-to-date Employer Form.

The ‘Regulatory Compliance Information’ section B of the Employer Form has been revised to indicate whether the employer’s business is currently compliant (i.e., has no outstanding orders) under the Ontario Employment Standards Act 2000 and the Ontario Occupational Health and Safety Act.

The employer has to review the information listed in the Employer Form to respond accurately in order to avoid unnecessary delays in the processing of your application.

In the event of technical difficulties while using the OINP e-Filing Portal, the applicant can contact OINP directly at: ontarionominee@ontario.ca, attach a screen shot showing the time and date stamp, and include details regarding the error.

December 20 - Ontario PNP To Increase Nominations for Permanent Residence

Currently Ontario Provincial Nomination Program (PNP) can nominate 6,650 applicants every year.  As the demand for skilled workers has increased, Ontario is seeking to increase its allocation to 13,300 by 2020.

As the actual labour needs in the province has been increasing by leaps and bounds, the present allocation does not reflect this need and has fallen far short of meeting the needs of the employers, which has inversely had a negative impact on the growth and sustainability of businesses in the province. This year the ‘Human Capital Priorities Stream’ has been used to mitigate the shortage of skilled workers in the IT sector.

Immigration, Refugees and Citizenship Canada (IRCC) sets all the provinces allocations in the PNP according to the immigration annual admission target. The admission target for this year is to issue 61,000 permanent residence visas; next years (2020) target is slated to be 67,000. However, it is worth mentioning that Ontario receives the largest chunk of the allocation from the rest of the provinces and territories.

The Ontario Immigrant Nominee Program (OINP) has issued 15 Invitations to Apply (ITAs) in the Entrepreneur Stream. The minimum score was 127. Expressions of Interest that were scored by September 12, 2019 were the only ones eligible for consideration for this draw.

The Entrepreneur Stream is an immigration stream under the Ontario Immigrant Nominee Program (OINP). This stream is for entrepreneurs from outside of Canada interested in starting a new business or buying an existing business in Ontario.

It gives an entrepreneur (and up to one foreign national business partner) the opportunity to be nominated for permanent residence once their business has been established in Ontario.

The Entrepreneur Stream application is a two-stage process.

Stage 1

1.     Register an expression of interest by email

2.     If invited, submit an online application

3.     The entrepreneur and business partner (if applicable) attend a mandatory in-person interview at the OINP office in Toronto

4.     If their stage 1 application is successful, they must sign a performance agreement

Stage 2

1.     They get a temporary work permit support letter to enable them to apply to IRCC for a temporary work permit

2.     Establish the business – they have 20 months to implement their business plan and submit a final report

3.     If their business meets all requirements, they are eligible for nomination for permanent residence.

If you are identified in the pool, you will receive a Notification of Interest (NOI) in your IRCC online account.

After you receive an NOI, you may submit an online application to the OINP if you qualify under one of Ontario’s Express Entry streams. You must submit your application within 45 calendar days of receiving your NOI.
